Terms of Service

Hardly Art Tattoo Studio provides flash and custom tattoo services. Sessions are offered as half-day and full-day bookings, with smaller pieces and flash scheduled at our discretion. Submitting a tattoo request does not guarantee an appointment. All requests are subject to review and acceptance by the artist, who reserves the right to decline any project for any reason, including subject matter, placement, or scheduling constraints.

You must be at least 18 years of age to receive tattoo services or to submit a tattoo request through our website. By using our booking system, you represent and warrant that you are 18 years of age or older. We reserve the right to require valid government-issued photo identification before providing any services, and we will refuse service to anyone unable to verify their age.

Booking. Appointments may be requested through our online tattoo request form or booked directly through our online booking system. Based on the size of the piece you select, the request form directs you to a half-day or full-day session booking. A $100 deposit is required at the time of booking to confirm the appointment.

Pricing. The final cost of your tattoo is determined by the artist based on the design, size, placement, and time required, and is discussed with you in connection with your appointment. Custom quotes for smaller pieces are provided by the artist and are valid for the scheduled appointment only.

Payment Methods. We accept payment by cash or through our payment processor, which may include credit/debit cards, Apple Pay, and buy-now-pay-later options such as Klarna or Afterpay. Payments processed online are handled by third-party payment processors; we do not store your full payment card information.

Deposits. Any deposit paid is applied toward the final cost of your tattoo. Deposits are non-refundable except as described in Section 4.

• Rescheduling by client: You may reschedule your appointment by contacting us at least 48 hours before your scheduled time. Payments and deposits transfer to the rescheduled appointment.
• Late cancellations and no-shows: Cancellations with less than 48 hours' notice, and failures to appear for a scheduled appointment, may result in forfeiture of the deposit or a portion of prepaid session fees.
• Cancellation by the studio: If we must cancel or reschedule your appointment for any reason (including artist illness or emergency), you may choose between rescheduling at no additional cost or receiving a full refund of amounts paid for the affected appointment.
• Completed services: Due to the custom and permanent nature of tattoo work, all sales are final once services are rendered. Refunds are not provided for completed tattoos.

By booking an appointment, you agree to:

• Provide accurate and truthful information on all request, intake, and consent forms, including health information relevant to tattooing
• Disclose any allergies, skin conditions, medications, or medical conditions that may affect the tattoo process or healing
• Arrive on time, sober, and in suitable condition to be tattooed; we reserve the right to refuse service and retain deposits if you arrive under the influence of alcohol or drugs
• Follow all aftercare instructions provided; healing outcomes depend significantly on aftercare compliance
• Complete and sign our consent and release form prior to receiving services

Custom designs created by Hardly Art Tattoo Studio remain the intellectual property of the artist. We may photograph completed work for our portfolio and marketing (including social media); if you prefer your tattoo not be photographed or shared, tell us before your session and we will honor that request. Design previews and drawings are provided for your appointment only and may not be taken to another artist or reproduced without permission. We do not copy another artist's custom work; reference images you submit are used for inspiration and style guidance.

Tattooing involves inherent risks, including but not limited to infection, allergic reaction, scarring, and dissatisfaction with the final appearance. We follow applicable health and safety regulations and industry-standard sterilization practices. By receiving services, you acknowledge these risks and agree that you will be required to sign a separate consent and release form before any tattoo procedure. Nothing in these Terms limits any rights you may have under applicable law that cannot be waived.

If you provide your mobile number and opt in, we may communicate with you by text message regarding your tattoo request, appointments, aftercare, and related matters. Message frequency varies; message and data rates may apply. Reply STOP to opt out at any time, or HELP for assistance. Consent to receive text messages is not a condition of purchasing any services. Our collection and use of your mobile information is described in our Privacy Policy, which is incorporated into these Terms by reference. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

You agree to use our website and booking system only for lawful purposes and for legitimate tattoo inquiries. You may not submit false information, upload unlawful or infringing content through our request form, attempt to interfere with the operation of the site, or use automated means to access or scrape the site. Content you upload (such as reference images) must be content you have the right to share.

Our website and booking system are provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted or error-free. To the fullest extent permitted by law, Hardly Art Tattoo Studio's total liability for any claim arising out of your use of the website or booking system shall not exceed the amount you paid for the applicable service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability arising from gross negligence or willful misconduct.

You agree to indemnify and hold harmless Hardly Art Tattoo Studio and its owner, employees, and contractors from claims, damages, or expenses arising from your violation of these Terms, your misrepresentation of information provided to us (including age or health information), or your infringement of any third party's rights through content you submit.

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Kootenai County, Idaho, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
